How to post bail at the McLennan County Jail

The three ways to get someone out, the paperwork rules the Sheriff’s bond office enforces, and what happens between arrest and release.

Three ways to post bail in McLennan County

  • Surety bond through a licensed bondsman. You pay the company a non-refundable premium, and the company guarantees the full bail. Only agencies licensed by the McLennan County Bail Bond Board can write these bonds; check the active bail bonding agencies roster.
  • Cash bond. You deposit the full bail amount with the county. It is generally returned, minus any fees or court costs, after the case ends and all appearances are made.
  • Personal bond. Release on a promise to appear, granted by a magistrate or judge, with a $20 county fee and weekly call-in. See personal bonds.

What the Sheriff’s bond office requires

The Sheriff’s Office bond page sets out specific rules for bonds submitted at the jail. A bondsman handles these every day, but it helps to know them if you are posting a cash bond yourself or checking paperwork:

  • The court date must be written as “Instanter.”
  • Bring the original bond, a copy stamped in red ink “Defendant Copy,” and the money order, all together.
  • The bond amount must include the word “dollars.”
  • Misdemeanor bonds must show “County Courts at Law” as the court.
  • The town of appearance must include the state.
  • The bond must be notarized on the same date it is made.
  • For offenses covered by Article 17.081 of the Code of Criminal Procedure (effective September 1, 2021), the bond must include the defendant’s and each surety’s address, ID number and issuing state.

Step by step after an arrest

  1. Confirm the person is booked and find the charge and bail amount on the official jail roster search, or call jail intake at (254) 757-5120.
  2. Wait for magistration. Bail is set by a magistrate, often within 48 hours of arrest under Texas Code of Criminal Procedure Chapter 17.
  3. Choose how to post. For a surety bond, call a licensed company and have the defendant’s full name, date of birth, booking number and charges ready.
  4. Sign the paperwork and pay the premium. Ask for the payment, collateral and cosigner terms in writing.
  5. The bond is filed at the jail. Release processing takes additional time after the bond is accepted.
